CAPABLE DOMESTIC VIOLENCE LAWYERS IN JERSEY CITY AND NEW YORK
SAFEGUARDING YOUR RIGHTS AND YOUR REPUTATION
New Jersey and New York have taken determined steps to curb domestic violence, including enacting mandatory arrest laws. If you’ve been arrested on charges of domestic violence, you face jail time, fines and even anger management classes. On top of that, your reputation may suffer if a conviction brands you as an abuser. That result could have more than an intangible effect on your life; if you have children, it could negatively impact your standing in custody and visitation talks. For more than 30 years, The Anthony Pope Law Firm has protected the rights and reputations of numerous clients in domestic abuse cases.
PROACTIVE DEFENSE TO CHARGES OF HOME VIOLENCE IN NEWARK AND VICINITY
New Jersey’s mandatory arrest provision in its domestic violence statute may be well intentioned, but it compels police officers to arrest suspected abusers on the scantest evidence. Specifically, the law says an officer must arrest when “the victim exhibits signs of injury caused by an act of domestic violence.” And what does it mean to exhibit signs? The statute says this can include “manifestations of an internal injury suffered by the victim.” The statute doesn’t define “manifestations,” so that’s wide open to interpretation. Would doubling over in apparent pain be a manifestation of internal injury? Would that level of “proof” open the door to fakery?
Most domestic violence cases come down to “he said, she said.” Many claims are patently false and motivated by a desire to hurt the accused person. But regardless of the facts in your case, if you don’t retain capable representation, you could carry the label of “abuser” for the rest of your life. We are experienced violent crimes attorneys who can assert your rights forcefully in court and, in some cases, can even have your arrest record expunged.
